These Terms of Service ("Terms") govern your use of Crawlability.ai and its websites, applications, APIs, dashboards, reports, tools, subscriptions, credits, and related services ("Services").

By creating an account, purchasing a subscription, accessing the Services, or otherwise using Crawlability, you agree to these Terms.

1. Contracting Entity

Crawlability is operated principally by Elystra Private Limited, Tamil Nadu, India ("Elystra").

For customers in the United States, LeapStripe LLC, Delaware, USA ("LeapStripe") acts as the contracting and billing entity.

Unless an Order Form or checkout states otherwise, US customers contract with LeapStripe LLC and all other customers contract with Elystra Private Limited. "Crawlability," "we," "our," and "us" refer to the applicable contracting entity.

An Order Form, enterprise agreement, or other written agreement may specify a different contracting entity or additional terms.

2. Crawlability Services

Crawlability provides tools for evaluating and improving how websites, brands, organizations, products, and information are discovered, interpreted, cited, referenced, or recommended by artificial intelligence systems.

The Services may include:

  • AI discoverability measurement;
  • AI readiness measurement;
  • Crawlability Scores;
  • AI Presence and AI Visibility measurements;
  • AI mention monitoring;
  • prompt intelligence;
  • competitor visibility measurement;
  • citation monitoring;
  • technical website analysis;
  • optimization recommendations;
  • AI-generated recommendations;
  • competitive intelligence; and
  • related reports and analytics.

Features may change as AI platforms, APIs, search systems, and technology evolve.

3. Accounts

You are responsible for:

  • providing accurate account information;
  • protecting your account credentials;
  • activity occurring through your account;
  • ensuring users you authorize comply with these Terms; and
  • notifying us promptly of suspected unauthorized account access.

You may not share credentials in a way that circumvents account or subscription limits.

4. Credits

Certain Crawlability functions consume credits.

The number of credits required for a particular operation may vary depending on the feature, AI engine, number of prompts, number of competitors, complexity of the measurement, or other processing requirements.

We may change future credit consumption rates when operational or third-party processing costs change. Changes will not retroactively remove credits already consumed.

Subscription Credits

Credits included with a monthly or annual subscription are allocated according to the applicable plan.

Unless specifically stated otherwise:

  • subscription credits reset at the end of each monthly billing cycle;
  • unused subscription credits do not roll over into the next cycle, except on agency plans, which include credit rollover as specified in the applicable plan;
  • subscription credits have no cash value; and
  • unused subscription credits are forfeited when the subscription terminates or expires.

Purchased Credit Packs

Credits purchased separately from a subscription:

  • are associated with the purchasing account;
  • cannot ordinarily be transferred between accounts;
  • have no cash or monetary value;
  • may not be resold; and
  • expire 12 months after purchase, unless a different expiry period was expressly stated when purchased.

Promotional Credits

Free, trial, referral, promotional, or bonus credits may have different expiration periods and may be withdrawn in cases of fraud, abuse, error, or violation of promotion terms.

Refunds

Credits, subscriptions, and credit packs are non-refundable once purchased or allocated, except where:

  • applicable law requires a refund;
  • we expressly agree otherwise in writing; or
  • there has been a billing error attributable to Crawlability.

Consumption of credits represents payment for processing resources and measurements requested by the user and does not depend on whether the resulting score, measurement, or AI response is favorable to the user.

5. AI Measurements and Non-Deterministic Results

Crawlability relies partly on third-party artificial intelligence systems including OpenAI, Google Gemini, Anthropic Claude, Perplexity, and potentially other AI systems.

Artificial intelligence outputs are inherently probabilistic and may change between requests.

You acknowledge that:

  • identical or substantially similar prompts may produce different responses;
  • AI engines may change their models, ranking methods, retrieval systems, sources, policies, and behavior without notice to Crawlability;
  • an AI engine may mention a brand during one measurement and not mention it during another;
  • citations and sources may change;
  • geographic location, personalization, model version, query formulation, timing, and other factors may affect results;
  • Crawlability scores and recommendations are analytical estimates rather than guarantees; and
  • historical performance does not guarantee future AI visibility.

Accordingly, Crawlability does not warrant or guarantee the accuracy, completeness, reproducibility, ranking position, citation frequency, recommendation frequency, AI visibility, business outcome, traffic increase, revenue increase, or other result of any score, report, recommendation, or measurement.

Crawlability's reports and scores are intended to support analysis and decision-making. They should not be treated as statements of absolute fact regarding how every AI system will respond to every user.

6. Third-Party AI Processing

To provide measurements, Crawlability may submit information including:

  • domains;
  • URLs;
  • brand names;
  • competitor names;
  • product names;
  • prompts;
  • keywords; and
  • public business information

to third-party AI providers including OpenAI, Google Gemini, Anthropic Claude, and Perplexity.

By requesting a measurement, you authorize Crawlability to perform these queries for the purpose of providing the Services.

You must not submit confidential, protected, personal, or sensitive information unless you have the legal authority to process that information through the Services.

7. Competitor and Third-Party Brand Measurement

Crawlability allows users to measure public information and publicly observable AI responses relating to brands, websites, organizations, and competitors.

You may use Crawlability to:

  • query AI systems about competitors;
  • compare AI visibility between brands;
  • measure whether another organization is cited or recommended;
  • analyze publicly accessible competitor websites;
  • compare public content and AI responses; and
  • conduct legitimate competitive, marketing, search, and market intelligence research.

The fact that a brand is measured does not imply that the brand endorses, sponsors, or is affiliated with Crawlability or the user conducting the measurement.

You may not use these functions to:

  • impersonate another organization;
  • misrepresent an affiliation;
  • unlawfully obtain confidential information;
  • infringe intellectual property rights;
  • harass another person or organization; or
  • violate applicable law.

8. Acceptable Use

You may not use Crawlability to:

  • violate applicable law;
  • distribute malware or malicious code;
  • interfere with Crawlability's infrastructure;
  • gain unauthorized access to accounts or systems;
  • evade rate limits or security controls;
  • scrape the Services in an unauthorized manner;
  • reverse engineer proprietary portions of the Services except where applicable law prohibits such restriction;
  • resell Services without authorization;
  • submit content you do not have a right to process;
  • conduct fraudulent measurements;
  • use Crawlability to facilitate unlawful surveillance or discrimination; or
  • abuse third-party AI providers.

We may suspend or restrict activity that threatens the integrity, security, availability, or lawful operation of the Services.

9. Intellectual Property

Crawlability and its licensors retain all rights in:

  • Crawlability software;
  • platform design;
  • scoring methodology;
  • algorithms;
  • workflows;
  • databases;
  • dashboards;
  • interfaces;
  • trademarks;
  • documentation; and
  • proprietary technology.

Except for the limited right to use the Services under these Terms, no ownership rights are transferred to you.

Your Content

You retain ownership of information and materials you submit to Crawlability.

You grant us a limited right to process those materials as necessary to provide, secure, maintain, and improve the Services and fulfill your requests.

Reports

Subject to payment of applicable fees and these Terms, you may use and internally distribute reports generated for your organization.

You may provide reports to clients where your subscription expressly permits agency, consulting, white-label, or client use.

10. Third-Party Services

The Services integrate with or depend upon third parties including AI providers, cloud infrastructure providers, payment processors, and other technology services.

We are not responsible for outages, errors, policy changes, model changes, discontinued APIs, incorrect third-party information, or other actions outside our reasonable control.

A change made by an AI engine or third-party platform may alter Crawlability results without any change having been made by Crawlability.

11. Fees and Billing

Paid subscriptions are billed according to the pricing and billing period displayed when you purchase the Services.

Unless otherwise specified:

  • subscriptions renew automatically;
  • applicable taxes may be added;
  • you authorize the applicable payment provider to charge your selected payment method; and
  • cancellation prevents future renewal but does not ordinarily create a refund for the current billing period.

Enterprise agreements and Order Forms may contain different billing provisions.

12. Termination

You may stop using Crawlability at any time.

You may cancel a subscription through the functionality provided in your account or by contacting us where applicable.

We may suspend or terminate access where:

  • fees remain unpaid;
  • these Terms are materially violated;
  • use creates a security or legal risk;
  • activity is fraudulent or abusive;
  • continued service would violate third-party provider requirements; or
  • required by law.

Sections that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability, payment obligations, and governing law.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available."

We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy to the extent legally permitted.

We do not guarantee that:

  • AI engines will return any particular response;
  • a brand will receive a particular score;
  • implementing recommendations will result in improved AI visibility;
  • AI visibility will result in website traffic, leads, sales, or revenue;
  • third-party platforms will remain available; or
  • measurements taken at different times will be identical.

14. Limitation of Liability

To the maximum extent permitted by applicable law, neither Crawlability nor its affiliates, directors, officers, employees, contractors, or suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, loss of goodwill, or loss of data.

To the maximum extent permitted by law, Crawlability's aggregate liability arising from or relating to the Services will not exceed the amounts actually paid by you to Crawlability during the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless the applicable Crawlability contracting entity and its affiliates, officers, employees, and representatives against third-party claims arising from:

  • your unlawful use of the Services;
  • content or information you submit without appropriate rights;
  • your violation of these Terms; or
  • your infringement of another party's rights.

16. Changes to the Services

AI technology changes rapidly.

We may modify, introduce, discontinue, replace, or limit features where reasonably necessary due to:

  • technical developments;
  • AI provider changes;
  • security requirements;
  • legal requirements;
  • third-party API availability;
  • commercial requirements; or
  • improvements to the Services.

17. Governing Law

Customers Contracting with LeapStripe

If your contracting entity is LeapStripe LLC, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Subject to any mandatory consumer rights that may apply, disputes shall be subject to the jurisdiction of the appropriate state or federal courts located in Delaware.

Customers Contracting with Elystra Private Limited

If your contracting entity is Elystra Private Limited, these Terms are governed by the laws of India. Subject to applicable law, courts located in Tamil Nadu, India shall have jurisdiction over disputes arising from these Terms.

Any applicable mandatory statutory or consumer protection rights remain unaffected.

18. General Terms

If any provision of these Terms is unenforceable, the remaining provisions remain effective.

A failure to enforce a provision does not waive our right to enforce it later.

You may not assign these Terms without our written consent. We may assign these Terms as part of a corporate restructuring, merger, acquisition, financing, sale of assets, or transfer of the Crawlability business.

These Terms, together with applicable Order Forms, Privacy Policy, and other expressly incorporated agreements, constitute the agreement concerning your use of the Services.
